Testimonial Compulsion (సాక్ష్యపరమైన బలవంతం)

Being forced to make an oral or written statement conveying one's own personal knowledge — the specific kind of compulsion Article 20(3) protects an accused against, as distinguished from physical or identification evidence.

Real-life example

Forcing an accused to reveal where he hid stolen property through a compelled statement is testimonial compulsion; compelling him to stand in an identification parade is not.

Where you'll come across this

The core distinction drawn by the 11-judge bench in State of Bombay v. Kathi Kalu Oghad (1961), separating protected testimonial acts from unprotected physical evidence like fingerprints, handwriting, or voice samples.

Common mix-up

Often used interchangeably with "Self-Incrimination," but this term specifically names the MECHANISM (a compelled testimonial act) rather than the broader protected outcome (not incriminating oneself).
