FACTS

Kathi Kalu Oghad was charged with murder under Section 302 read with Section 34 of the Indian Penal Code, and under Section 19(e) of the Indian Arms Act. During the investigation, the police obtained specimen handwriting samples from him on three occasions while he was in custody, and used this evidence to help identify him as the person responsible. The trial court convicted him based partly on this evidence and sentenced him to life imprisonment. On appeal, the High Court held that the handwriting-sample evidence was inadmissible, since it had been obtained through compulsion while he was in police custody, and acquitted him.

The State of Bombay appealed to the Supreme Court. Because the case required reconsidering the broader interpretation of Article 20(3) laid down in M.P. Sharma v. Satish Chandra (1954) — which had suggested that "to be a witness" was equivalent to "to furnish evidence" of any kind, potentially extending the privilege against self-incrimination even to the production of documents or physical material — an eleven-judge bench, the largest ever constituted by the Supreme Court up to that point, was assembled to authoritatively settle the true scope of the constitutional guarantee.

JUDGEMENT

By an 8:3 majority, the eleven-judge bench held that compelling an accused to give specimen handwriting, signature, or thumb, finger, palm, or foot impressions for comparison does not amount to "being a witness against himself" under Article 20(3), since such material evidence does not involve conveying personal knowledge relevant to facts in issue — the protection is confined to testimonial compulsion. The broader interpretation in M.P. Sharma v. Satish Chandra (1954) was accordingly narrowed to this extent.

This distinction continues to be applied to determine whether newer forms of evidence-gathering — DNA samples, voice samples, narco-analysis, or polygraph tests — fall within or outside the constitutional privilege against self-incrimination, with later cases such as Selvi v. State of Karnataka (2010) building directly on this foundational testimonial/physical divide. It is also historically notable as the first-ever eleven-judge bench convened by the Supreme Court, reflecting the significance the Court attached to correctly settling this question.
