Yashwant Trimbak Oke v. State of Maharashtra (1995)

A festival tradition does not automatically come with a right to use loudspeakers, especially once actual measurements show the noise already crosses safe limits. This Bombay High Court case tested a request to allow loudspeakers during Navratri against real, court-ordered noise readings.

FACTS

An application was made for permission to use loudspeakers during the Navratri festival, when Garba (a traditional group dance) is performed at night in public grounds across Mumbai. The petitioners objected, arguing that the loudspeakers being used added significantly to the city's noise pollution. To test the real impact rather than decide on assumptions, the court directed joint noise measurements to be taken at different locations across the city during the festival.

ISSUES

i. Should permission for loudspeakers during Navratri be granted merely because it is an established festival practice, without examining its actual noise impact?
ii. If measured noise levels exceed the permissible standards under the Environment (Protection) Act, 1986, can loudspeaker use still be allowed?

ANALYSIS
  • The court questioned the very premise of the application, noting that Garba is a dance performed and enjoyed by the crowd itself through live drumming and singing — it does not actually need a loudspeaker to be danced to. This meant the "necessity" of loudspeakers for the festival was doubtful from the outset.
  • Rather than relying on impressions, the court ordered actual joint measurements of noise levels at various points across the city during the festival — grounding the decision in evidence under the Environment (Protection) Act, 1986 (Sections 15 and 17, which deal with penalties and offences by companies/authorities for contravening the Act's standards) rather than in general assertions from either side.
  • The measurements showed noise levels already exceeding the permissible limits. Balancing this against Article 19 rights (freedom of expression and the right to practise culture), the court held that a claimed right to cultural expression could not override a demonstrated, measured breach of statutory noise limits that harmed the wider public.
JUDGEMENT

The Bombay High Court declined to grant blanket permission for loudspeakers during the Navratri festival, holding that since Garba does not require a loudspeaker and measured noise levels already exceeded permissible limits under the Environment (Protection) Act, 1986, unrestricted use could not be allowed.

CONCLUSION

Yashwant Trimbak Oke v. State of Maharashtra shows courts insisting on real, measured evidence before allowing loudspeaker use for festivals, rather than accepting "tradition" as an automatic justification. It reinforced that statutory noise limits under the Environment (Protection) Act apply even to religious and cultural celebrations, feeding into the broader line of cases balancing festive/religious practice against the public's right to a reasonably quiet environment.

Yashwant Trimbak Oke v.
