FACTS

The defendant, Downton, as a practical joke, falsely told the plaintiff, Mrs. Wilkinson, that her husband had met with a serious accident, that both his legs had been broken, and that he was lying injured at "The Elms" public house, asking her to go and fetch him home on a cart with cushions. Mrs. Wilkinson believed the statement to be true. The shock of the news caused violent physical effects in her, including vomiting and other serious consequences, and she became seriously ill for some time as a result, requiring medical treatment. Expenses were incurred both by her and by her husband on account of her illness. Mrs. Wilkinson sued Downton for the harm caused to her by his false statement.

JUDGEMENT

Wright J. gave judgment for the plaintiff, Mrs. Wilkinson, holding Downton liable for the physical and nervous harm she suffered as a result of his false statement.
