Volenti non fit injuria means that no injury is done to one who consents. Where the plaintiff has, with full knowledge of a specific risk, voluntarily agreed to bear it, the defendant is not liable if that very risk materialises and causes harm.
A spectator at a motor race who is injured when a car leaves the track and crashes into the crowd enclosure cannot ordinarily sue the organisers, having voluntarily accepted the risks inherent in watching a hazardous sport — as held in Hall v. Brooklands Auto Racing Club (1933).
Unit 2, Post 1 on General Defences, as the defence requiring both full knowledge of the risk and voluntary acceptance of it.
Don't confuse mere knowledge of a risk with actual consent to bear it — knowledge alone (sometimes called scienti non fit injuria) is not enough; the plaintiff must also have voluntarily agreed to accept the risk. The defence also fails where a protective statute exists specifically for the plaintiff's benefit, even if the plaintiff appeared to accept a dangerous condition.
