FACTS

Dev Dutt Sharma, a coparcener in a Mitakshara joint Hindu family, died in 1999, survived by his widow, three sons (including Rakesh Sharma) and two daughters (including Vineeta Sharma). One of the sons filed a suit for partition of the joint family properties in 2002. Since the father had died in 1999 and the suit was filed in 2002 — both years before the Hindu Succession (Amendment) Act, 2005 came into force on 9 September 2005 — the suit was still pending on that date. The daughters claimed an equal coparcenary share under the newly amended Section 6, on the footing that the amendment operated retroactively. The other family members resisted this, arguing that because the father — the coparcener through whom the daughters traced their claim — was already dead before 9 September 2005, Section 6 as amended could not confer coparcenary status on the daughters at all.

ISSUES

ANALYSIS

JUDGEMENT

The Supreme Court held that Section 6, as amended in 2005, confers coparcenary status on a daughter by birth, in exactly the same manner as a son, and that this status does not depend on whether her father was alive on 9 September 2005. It overruled the "living coparcener" requirement laid down in Prakash v. Phulavati, and approved the ultimate outcome reached in Danamma. The Court further held that only a partition effected by a registered instrument or a final court decree before 20 December 2004 falls within the saving clause of Section 6(5) — an oral partition, however long acted upon by the family, does not qualify. Because the amendment operates retroactively rather than retrospectively, it applies to every partition suit still pending on the date the amendment came into force, regardless of when that suit was originally filed. Applying this reasoning to the facts, Vineeta Sharma and her sister were held entitled to be treated as coparceners with a share equal to that of their brothers, and the pending partition suit had to proceed on that footing.

CONCLUSION

Vineeta Sharma resolved a decade of conflicting High Court and Supreme Court rulings and secured genuine, birthright equality for Hindu daughters in coparcenary property, irrespective of when their father died. By insisting on formal, registered or judicially recorded proof of any pre-2005 partition, it also closed off the most obvious route families might otherwise have used to defeat the reform through informal, undocumented arrangements — making the case as significant for its procedural holding on "partition" as for its central ruling on birthright coparcenary status.
