FACTS
The Vellore Citizens Welfare Forum, a non-governmental organisation, filed a writ petition under Article 32 of the Constitution against widespread pollution caused by numerous tanneries and other leather-industry units operating in the districts of Vellore, Erode, and Tiruppur in Tamil Nadu. JUDGEMENT
The Supreme Court held that the Precautionary Principle and the Polluter Pays Principle are essential features of sustainable development, and are part of the law of the land. It directed the tanneries and other polluting industries in the Vellore, Erode, and Tiruppur districts to set up effluent treatment plants (individual or common) within a stipulated time, failing which they were to be closed. It directed the Central Government to constitute an authority under Section 3(3) of the Environment (Protection) Act, 1986, with the power to assess and recover compensation from the polluting industries for the loss caused to the ecology and to affected individuals, following the polluter pays principle, and to utilise the compensation collected for restoring the environment and paying affected individuals.
