Vellikannu v. R. Singaperumal (2005)

Confirmed that Section 25's disqualification of a murderer is absolute and complete, operating through the Section 27 fiction that treats the murderer as having predeceased the intestate.

FACTS

A wife murdered her husband and was found to be complicit in his murder. Having been disqualified under Section 25 from inheriting her husband's estate on account of the murder, she nonetheless continued to press a claim to some interest in the property, contending that her disqualification should not be read as extending to every possible interest she might otherwise have held. The dispute reached the Supreme Court on the true scope of Section 25's disqualification.

ISSUES

  1. Whether the disqualification of a murderer under Section 25 is complete and absolute, extinguishing every possible interest in the property of the person murdered.
  2. How Section 27's fiction — that a disqualified person is deemed to have predeceased the intestate — operates to determine the further devolution of the estate.

ANALYSIS

  • The Court examined the unqualified language of Section 25, which disqualifies a murderer from inheriting the property of the person murdered and any other property whose succession the murder was meant to advance.
  • It held that Parliament intended a complete bar, with no scope for recognising any partial or conditional entitlement surviving the disqualification.
  • The Bench explained that Section 27's predecease fiction is precisely the mechanism that gives full effect to this complete disqualification, treating the murderer as though she never existed in the line of succession.

JUDGEMENT

The Supreme Court held that disqualification under Section 25 is absolute and complete — a person who murders, or abets the murder of, the person whose property is in question loses every interest whatsoever in that property. The further devolution of the estate is worked out under Section 27 exactly as though the disqualified person had died before the intestate.

CONCLUSION

This decision confirms that Section 25's disqualification is not merely a procedural bar to formal inheritance but a total and permanent extinguishment of any claim, reinforced by the Section 27 fiction — closing off any argument that a disqualified murderer might retain some lesser, residual interest in the property of the person they killed.
