Trespass to Land —

Trespass to land is a direct, unlawful interference with a person's possession of land, actionable per se — the plaintiff need not prove any actual damage, however slight the intrusion.

Real-life example

In Entick v. Carrington (1765), King's messengers broke into a writer's house under a general warrant and carried away his papers; the court held them liable for trespass, declaring that no man can set foot on another's land without licence, however minute the invasion.

Entick v.

Where you'll come across this

The subject of Unit 3, Post 5, and the direct-interference counterpart to nuisance, examined in Post 6.

Common mix-up

Don't confuse trespass to land with nuisance. Trespass requires a direct physical entry onto the plaintiff's land and is actionable without proof of damage; nuisance arises from an indirect interference — like smoke or noise drifting onto the land — and generally requires the plaintiff to show actual damage or substantial discomfort.
