FACTS
A large lead and zinc smelter at Trail, in the province of British Columbia, Canada, roughly 11 kilometres north of the border with the American state of Washington, had been in operation since 1896 and expanded significantly in the years that followed under the Consolidated Mining and Smelting Company of Canada. From around 1925 onward, the smelter began emitting large volumes of sulphur dioxide fumes into the atmosphere. Prevailing winds carried these fumes south across the international boundary into the Columbia River valley in Washington State, where they damaged crops, orchards, pastureland, and forest trees over an extensive area of farmland belonging to American citizens. Repeated diplomatic protests by the United States government led the two countries to first refer the dispute to the International Joint Commission (a standing body created under the 1909 Boundary Waters Treaty), which in 1931 recommended compensation of $350,000 for damage up to 1 January 1932 — but the fumes and the damage continued afterward. The United States and Canada then signed the Convention of 15 April 1935, submitting the entire dispute to a three-member Arbitral Tribunal, and specifically asking it to decide whether damage had occurred since 1 January 1932, whether the smelter should be required to refrain from causing damage in the future, and what regime of operation the smelter should be required to follow.

JUDGEMENT
The Tribunal held Canada responsible in international law for the conduct of the Trail Smelter, awarded the United States US $78,000 as final compensation for damage caused between 1932 and 1937, and directed that the smelter thereafter be operated in conformity with a detailed regime of maximum permissible sulphur dioxide emissions set out in the award, subject to continued monitoring and a mechanism to address any future material damage. In its most quoted passage, the Tribunal declared: "no State has the right to use or permit the use of its territory in such a manner as to cause injury by fumes in or to the territory of another or the properties or persons therein, when the case is of serious consequence and the injury is established by clear and convincing evidence."

CONCLUSION
Although it was decided under a bilateral arbitration convention between only two States, the Trail Smelter Arbitration became the single most cited source for the customary international law "no-harm" (sic utere tuo ut alienum non laedas) principle — the idea that sovereignty over one's own territory carries a corresponding responsibility not to damage the environment of other States. Its language was carried almost verbatim into Principle 21 of the 1972 Stockholm Declaration and Principle 2 of the 1992 Rio Declaration, and it underlies the modern doctrine of State liability for transboundary environmental harm as well as the reasoning used against multinational enterprises whose operations cross borders. Every later instrument or dispute in this unit — from the Stockholm Declaration onward — builds on the rule this Tribunal first articulated in 1941.
