FACTS

In 1995, T.N. Godavarman Thirumulpad, whose family had historical timber interests in the Gudalur area of the Nilgiris in Tamil Nadu, filed a writ petition under Article 32 of the Constitution before the Supreme Court, initially seeking to prevent large-scale illegal deforestation and unauthorised timber operations occurring in the forests of the Nilgiris. Reports before the Court indicated that timber merchants and encroachers, operating with the acquiescence of local authorities, were felling forest produce and converting forest land to other uses without any of the approvals the Forest (Conservation) Act, 1980 required, and that this pattern of large-scale, unchecked deforestation was not confined to the Nilgiris but was occurring across many States. As the matter progressed, the Court permitted it to expand well beyond the original Nilgiris grievance, allowing interlocutory applications concerning forest destruction in other parts of the country to be tagged onto the same petition — including, notably, a report that a very large number of trees had been felled by the Uttar Pradesh Government's development authority at NOIDA to clear land for a project, arguably in violation of Section 2 of the Forest (Conservation) Act, 1980. A central, recurring difficulty the Court confronted was that state governments and forest officials, when confronted with allegations of illegal diversion, routinely argued that the land in question was not "forest" in any formally notified sense — not a Reserved Forest, not a Protected Forest, sometimes merely revenue or "unclassed" forest land — and that the Forest (Conservation) Act, 1980, on its own terms, therefore did not apply to restrain what was being done with it.

ANALYSIS

  • The Court reasoned that the Forest (Conservation) Act, 1980 was enacted specifically to check continued deforestation, and that a narrow, purely notification-based reading of "forest" would defeat this very purpose — since it would let States and private parties escape the Act's restrictions simply by pointing out that the deforested land, however plainly forest in character, had never been through the formal Reserved/Protected Forest notification process under the Indian Forest Act, 1927.

  • Accordingly, the Court held that "forest land", occurring in Section 2 of the Act, must be construed to cover not merely land recorded as forest in the dictionary sense, but also any area recorded as "forest" in any Government record, whatever the classification or ownership of that land — deemed forest, unclassed forest, or private land recorded as forest in revenue records, was all brought within the Act's reach by this single interpretive move.

  • Recognising that no single order could immediately resolve the vast, nationwide scale of the problem the petition had revealed, the Court adopted the technique of continuing mandamus — keeping the writ petition alive indefinitely, issuing successive directions over time, and requiring periodic compliance reports from every State Government, rather than disposing of the matter with one final judgment. This allowed the Court to direct all State Governments to constitute Expert Committees to identify forest areas, forest produce, and running saw mills/timber operations within one month, and to ensure that no non-forest activity continued in any forest without prior Central Government approval, felling of trees in any forest was to stop except in accordance with a working plan approved by the State Government and in conformity with the Central Government's earlier guidelines, and that unlicensed saw mills, veneer, and plywood units operating within a specified distance of forest areas were to be closed.

  • The Court further reasoned that the Central Government's approval requirement under Section 2 must be read as a genuine, substantive check — not a formality — precisely because state-level economic and political pressure to permit forest diversion was the very problem the 1980 Act had been enacted to counteract; leaving compliance to self-assessment by the same state authorities whose conduct was under challenge would have reproduced the pre-1980 problem in a different guise.

JUDGEMENT

The Supreme Court held that the word "forest" must be understood according to its dictionary meaning, and that "forest land", as used in Section 2 of the Forest (Conservation) Act, 1980, covers all statutorily recognised forests, whether designated as reserved, protected, or otherwise, as well as any area recorded as forest in Government records, irrespective of ownership. The Act's restrictions accordingly apply to all such forest land, and the Court directed that any non-forest activity presently being carried on within any forest land must cease forthwith unless the Central Government's prior approval had been obtained; that all ongoing operations of saw mills, veneer, and plywood industries within forest areas without such compliance be closed; that State Governments constitute Expert Committees within one month to identify forest and forest-adjoining areas and running wood-based industries; and that felling of trees in any forest be suspended except strictly in accordance with a working plan approved by the State Government and consistent with Central Government guidelines. The Court retained seisin of the matter, keeping the petition pending for continuous monitoring rather than closing it with this order.

CONCLUSION

The 12 December 1996 order in T.N. Godavarman Thirumulpad v. Union of India became the founding order of what is often called the "Forest Bench" of the Supreme Court — a continuing mandamus that remained active for decades, generating hundreds of subsequent orders on subjects ranging from mining in forest areas, compensatory afforestation, and net present value payments, to the constitution in 2002 of the Central Empowered Committee to assist the Court in monitoring compliance nationwide.
