FACTS
Under the 1958 Nehru–Noon Agreement between India and Pakistan, India agreed to transfer part of the Berubari Union (territory in Jalpaiguri district, West Bengal) to Pakistan, along with an exchange of certain enclaves. Doubt arose over what legal mechanism could give effect to this transfer, so the President referred three questions to the Supreme Court under Article 143 for its advisory opinion.
