A parish vestry meeting that turned angry gave English law one of its clearest illustrations of assault — proving that a threatening advance, stopped just short of contact, is still enough to make the defendant liable.

FACTS

At a parish vestry meeting, a large majority of those present voted to have the defendant, Myers, turned out of the meeting. Myers became angry at this and declared that he would rather pull the chairman — the plaintiff, Stephens, who was presiding over the meeting — out of his seat than be turned out himself. He then advanced towards Stephens with his fist clenched, climbing over one or two intervening chairs and tables to get at him. Before Myers could reach the chairman, however, he was stopped by the churchwarden, who intervened and prevented any actual contact from taking place. Stephens sued Myers for assault.

ANALYSIS

  • Tindal C.J. directed the jury that the real question for them was whether the defendant was, at the relevant time, advancing towards the plaintiff with the intent to strike him, in such a manner and to such a degree of proximity that he was within striking distance of the plaintiff.

  • The fact that Myers was stopped by the churchwarden before he could actually reach and strike Stephens does not undo the assault already committed — the apprehension created in Stephens' mind by the advance, coupled with the apparent present ability to carry out the threat, was itself the legal wrong.

  • The intervention of a third party merely prevented the assault from escalating into a battery (actual physical contact); it did not retroactively erase the separate and already-completed wrong of assault caused by the threatening advance.

JUDGEMENT

Acting on Tindal C.J.'s direction, the jury found for the plaintiff, Stephens. Myers was held liable for assault, even though he never actually touched Stephens and was stopped before he could complete the act — because his advance with clenched fist and declared intent, made while within striking distance, was itself sufficient to constitute the tort.

CONCLUSION

Stephens v. Myers illustrates, rather than originates, the settled principle that assault requires only a reasonable apprehension of imminent, unlawful physical contact — actual contact, which would make the act a battery instead, is not required. The case remains one of the standard textbook illustrations of assault because of how clearly it separates the moment of legal wrong (the threatening advance within striking distance) from the moment of physical contact, and because it confirms that outside intervention preventing completion of the act does not undo the assault already committed.
