The West Bengal Legislature enacted the West Bengal Special Courts Act, 1950 to provide for the speedier trial of certain offences, in the context of a serious post-independence backlog of criminal cases and communal/political disturbances the State Government wished to address quickly. On 26 February 1949, a mob of about fifty workers attacked the factory of Messrs. Jessop & Co. Ltd. at Dum Dum, killing three of its European supervisory staff and burning their bodies in a furnace. Anwar Ali Sarkar and forty-nine co-accused were charged with murder, offences under the Explosive Substances Act, and causing disappearance of evidence of the murder under the Indian Penal Code. By a notification dated 25 January 1950 issued under Section 5(1), the West Bengal Government directed that this case be tried by a Special Court. Following a trial under the Act's truncated procedure, the Special Court convicted the accused, imposing sentences that included transportation for life.

Sarkar challenged his conviction, arguing that Section 5(1) was unconstitutional because it conferred unguided, uncontrolled discretion on the executive to select which cases would face this harsher procedure, violating Article 14's guarantee of equal protection of the laws. The Calcutta High Court agreed and quashed the conviction on 28 August 1951, holding Section 5(1) void. The State of West Bengal appealed to the Supreme Court, and because the case raised a fundamental question about the scope of Article 14 itself, it was heard by a seven-judge bench.

JUDGEMENT
By a majority of 6:1, the Supreme Court held Section 5(1) of the West Bengal Special Courts Act, 1950 unconstitutional and void, as it conferred unguided and uncontrolled discretion on the State Government to select individual cases for trial by a Special Court, with no intelligible differentia distinguishing the selected cases from others left to the ordinary courts, in violation of Article 14. The Court held that Section 5(2)'s procedure was not itself void, but since Section 5(1) was the only provision actually directing individual cases (including Sarkar's) to a Special Court, its invalidity meant the Special Court had no valid jurisdictional basis to have tried Anwar Ali Sarkar and his co-accused at all — the Calcutta High Court's quashing of the conviction was accordingly upheld. Anwar Ali Sarkar is the founding case of Article 14 jurisprudence in India — it established, right at the Constitution's outset, that a classification is only as good as the differentia it actually rests on, and that a vague, universally-applicable object like "speedier trial" cannot substitute for a real, intelligible basis distinguishing who is treated differently and why. This case's insistence on a genuine differentia with a rational connection to the law's object was formally crystallised six years later into the classic twin test in Ram Krishna Dalmia v. Justice S.R. Tendolkar (1958). It also remains the standard illustration, cited in virtually every subsequent case involving unguided executive discretion to select who faces a different or harsher procedure, and its concern with discretion left unchecked by any legislative standard anticipates the later arbitrariness doctrine developed in E.P.
