FACTS

The Kerala Government, through Rule 13AA of the Kerala State and Subordinate Services Rules, 1958, provided that Lower Division Clerks belonging to Scheduled Castes and Scheduled Tribes would be given an additional, time-bound exemption from the departmental qualifying test otherwise required for promotion to the post of Upper Division Clerk, in recognition of the historic and continuing educational and social disadvantages faced by these communities. N.M. Thomas and other non-SC/ST Lower Division Clerks, who remained subject to the ordinary test requirement without any such extension, challenged Rule 13AA as violating Article 16(1)'s guarantee of equality of opportunity in matters of public employment, arguing that it granted an unequal advantage to a section of employees based purely on caste, and further contended that whatever preferential treatment the Constitution permitted for backward classes in this context could only be granted through the specific reservation mechanism under Article 16(4), not through a freestanding rule of this kind. The State defended the Rule as a legitimate and proportionate measure to give real effect to Article 16(4) and Article 335's directive to take SC/ST claims into consideration in public employment. Given the significance of the underlying question of principle, the matter was heard by a seven-Judge Bench.
