FACTS

Appa Balu Ingale, along with four others (including Shankar Babaji Patil and Rajaram Rama Sankpal), were accused of preventing members of the Harijan community — referred to in the evidence as "Mahars" — from drawing water from a newly-dug public borewell, declaring that they, being untouchables, had no right to the water, and threatening them with violence, including with a gun. The trial court convicted all five under Section 4 of the Protection of Civil Rights Act, 1955, sentencing each to one month's simple imprisonment and a fine of Rs. 100 (with a further five days' simple imprisonment in default of payment); Appa Balu Ingale was additionally convicted under Section 7 of the Act, though no separate sentence was awarded for that offence.

On appeal, the Additional Sessions Judge, Belgaum, upheld the conviction and sentence of Appa Balu Ingale, Shankar Babaji Patil, and Rajaram Rama Sankpal by judgment dated 5 September 1980, while acquitting the other two accused. The three remaining convicted persons then filed a criminal revision petition before the Karnataka High Court, where a Single Judge allowed the revision and acquitted all three. The State of Karnataka appealed to the Supreme Court by special leave against this acquittal. During the pendency of the appeal, Appa Balu Ingale died on 4 November 1991, and the appeal against him accordingly abated, leaving the remaining two respondents' acquittal for the Supreme Court to decide.

JUDGEMENT

The Supreme Court allowed the State's appeal, set aside the Karnataka High Court's judgment of acquittal, and restored the judgment of the Additional Sessions Judge, Belgaum, dated 5 September 1980, convicting and sentencing the surviving accused under Sections 4 and 7 of the Protection of Civil Rights Act, 1955. The appeal against Appa Balu Ingale himself had already abated due to his death during the pendency of the proceedings.
