State of Bombay v. F.N. Balsara (1951) (Landmark Case)

This case upheld the Bombay Prohibition Act's core ban on intoxicating liquor as a reasonable restriction under Article 19(6), while applying the doctrine of severability to strike down only those specific provisions that swept in medicinal and toilet preparations having no real connection to intoxication.

FACTS

In pursuit of the Directive Principle under (what is now) Article 47, which directs the State to endeavour to bring about prohibition of the consumption of intoxicating drinks, the Bombay Legislature enacted the Bombay Prohibition Act, 1949, a sweeping statute regulating the manufacture, possession, sale, and consumption of alcohol within the State. The Act's definition of substances covered by its restrictions was drawn extremely broadly, extending to "liquor" defined to include any liquid consisting of or containing alcohol, a formulation wide enough to capture not only country liquor, wine, beer, and spirits meant for drinking, but also a range of medicinal preparations, tonics, perfumes, and toilet articles that happened to contain alcohol only as an incidental preservative or solvent, with no intoxicating purpose or effect at all. The respondent, F.N. Balsara, challenged the Act's validity, arguing that its provisions restricting his ability to possess and use such alcohol-containing medicinal and toilet items, alongside its general prohibition on intoxicating liquor, violated his Fundamental Rights, including the freedom to carry on trade and to hold and use property, under Article 19. Given the significant practical stakes for public health regulation, personal liberty, and the reach of prohibition legislation more generally, the matter was placed before a Bench of the Supreme Court.

ISSUES

  1. Whether the Act's core prohibition on the manufacture, sale, and consumption of genuinely intoxicating liquor was a reasonable restriction on the right to trade under Article 19(1)(g), justified by Article 19(6) and the Directive Principle favouring prohibition.
  2. Whether extending the Act's restrictions to medicinal preparations, toilet articles, and other substances containing only incidental, non-intoxicating quantities of alcohol was similarly a reasonable restriction, or exceeded what was necessary to address the mischief of intoxication.
  3. If certain provisions were found invalid, whether those provisions could be severed from the rest of the Act without disturbing its overall prohibition scheme, or whether the entire Act had to fall.

ANALYSIS

  • On the core prohibition, the Court held that alcohol consumed for its intoxicating effect is inherently capable of causing serious individual and social harm, and a State prohibiting trade in genuinely intoxicating liquor pursues a legitimate public-welfare objective directly supported by the Directive Principle favouring prohibition; a restriction of this kind, being neither excessive in relation to the harm addressed nor arbitrary in its application to intoxicating substances, satisfied the test of reasonableness under Article 19(6).
  • On medicinal and toilet preparations, the Court held that these items, containing alcohol only incidentally as a preservative or solvent and possessing no genuine intoxicating character or purpose, fell entirely outside the mischief the Act was designed to address; restricting a person's ability to possess and use ordinary medicines or toiletries merely because they contained trace or incidental alcohol was an excessive and irrational extension of the prohibition scheme, unconnected to any real risk of intoxication, and therefore unreasonable.
  • On severability, the Court held that the categories of substances covered by the invalid extension (medicinal and toilet preparations, and similar items with only incidental alcohol content) were distinctly and readily separable, both linguistically and functionally, from the genuinely intoxicating liquors the Act's core provisions targeted; excising the invalid extension left the Act's essential prohibition scheme fully intact and workable, so severance rather than wholesale invalidation was the appropriate remedy.

JUDGEMENT

The Supreme Court upheld the Bombay Prohibition Act's core prohibition on the manufacture, sale, and consumption of intoxicating liquor as a valid and reasonable restriction under Article 19(6), but struck down those specific provisions of the Act that extended its restrictions to medicinal preparations, toilet articles, and similar substances containing only incidental, non-intoxicating amounts of alcohol, as an unreasonable and excessive restriction on Article 19(1)(f) and (g). Applying the doctrine of severability, the Court held that these invalid provisions could be cleanly excised without disturbing the validity or workability of the Act's remaining, genuinely prohibition-related provisions, which continued in force.

CONCLUSION

State of Bombay v. F.N. Balsara remains one of the earliest and most frequently cited illustrations of the doctrine of severability in Indian constitutional law, demonstrating how a court can preserve the core, valid purpose of a welfare-oriented statute while trimming away specific provisions that overreach into territory unconnected to the law's genuine object. Its reasoning — that a restriction must have a real, rational connection to the actual mischief being addressed, and cannot be justified merely because it happens to fall within a broadly worded statutory definition — continues to inform how courts test the reasonableness of restrictions under Article 19(6) and similar provisions well beyond the specific context of prohibition legislation.
