FACTS
The defendant, Rylands, owned a mill in Lancashire and engaged independent contractors to construct a reservoir on his land to supply water to the mill. Beneath the site chosen for the reservoir lay a number of old, disused mine shafts and passages belonging to a coal mine worked by the plaintiff, Fletcher — shafts which had been filled with loose earth and rubbish and were not visible on the surface, and whose existence and connection to Fletcher's workings the independent contractors failed to discover, even though reasonable investigation would have revealed them. Neither Rylands personally, nor his engineer, was shown to have known of the shafts; the failure to discover them was a failure on the part of the independent contractors carrying out the work. When the reservoir was filled, water burst through the old shafts and flooded Fletcher's mine, causing extensive damage. Fletcher's claim first went to arbitration by consent, with the arbitrator stating a special case for the opinion of the Court of Exchequer. That court, by a majority of two (Pollock, C.B. and Martin, B.), with Bramwell, B. dissenting, held that Rylands was not liable, since no trespass or nuisance in the conventional sense had been shown and no personal negligence on Rylands' part had been proved — the negligence, if any, being that of the independent contractors, for whom Rylands was not automatically answerable. Fletcher then took the case to the Court of Exchequer Chamber, where six judges heard the appeal together, and it was this court, through the judgment of Blackburn, J., that first formulated the rule that became inseparably associated with this case. JUDGEMENT
The House of Lords unanimously dismissed Rylands' appeal and affirmed the decision of the Court of Exchequer Chamber, holding Rylands liable to Fletcher for the damage caused by the escape of the water. In doing so, the House of Lords affirmed and gave lasting authority to what became known as the rule in Rylands v. Fletcher: a person who, for his own purposes, brings onto his land and there collects and keeps anything likely to do mischief if it escapes, must keep it at his peril, and if he does not do so, is answerable for all the damage that is the natural consequence of its escape — unless he can show that the escape was owing to the plaintiff's own default, or, perhaps, that it was the consequence of vis major or an act of God. Lord Cairns, L.C. added the further, defining qualification that this liability attaches only to a non-natural use of land, distinguishing it from an ordinary or natural use. Rylands was accordingly held strictly liable, notwithstanding the absence of any personal negligence on his part, because the reservoir was a non-natural accumulation of water on his land and the escape caused Fletcher's mine to flood.

CONCLUSION
Rylands v. Fletcher became one of the most influential doctrines in the common law of torts, establishing strict liability for the escape of dangerous things from land as a rule distinct from — and independent of — negligence, nuisance, and trespass, and generating around it the now-standard defences of act of God, act of a stranger, plaintiff's own default, statutory authority, and consent of the plaintiff. English courts later narrowed its reach further, notably in Read v. J. Lyons & Co. Ltd. (1947), which confined the rule to cases involving an actual escape of the dangerous thing beyond the defendant's premises, and in Cambridge Water Co. v. Eastern Counties Leather plc (1994), which required that the type of damage be reasonably foreseeable. In India, the rule governed liability for hazardous escapes for over a century, until the Supreme Court in M.C. Mehta v. Union of India (the Oleum Gas Leak Case, 1987) held that Rylands v. Fletcher's own built-in exceptions — act of God, act of a stranger, statutory authority, and the plaintiff's default — gave inadequate protection to victims of modern, ultra-hazardous industrial activity carried on in a thickly populated area, and departed from it altogether in favour of a stricter, exception-free rule of absolute liability for enterprises engaged in such hazardous activity.
