Right of Contribution — వాటా చెల్లింపు హక్కు

The right of contribution allows a tortfeasor who has been compelled to pay the entire amount of damages to the victim to recover a proportionate share back from the other tortfeasors equally or partly responsible for the same harm.

వాటా చెల్లింపు హక్కు అంటే, బాధితుడికి మొత్తం నష్టపరిహారం చెల్లించాల్సి వచ్చిన అపకారుడు, అదే హానికి సమానంగా లేదా పాక్షికంగా బాధ్యులైన ఇతర అపకారుల నుండి తగిన వాటాను తిరిగి పొందగలిగే హక్కు.

Real-life example

If a pedestrian recovers the full amount of damages from one of two independently negligent drivers whose separate carelessness combined to cause the accident, that driver can seek contribution from the other driver in proportion to their respective share of fault.

Common mix-up

Don't assume the old rule in Merryweather v. Nixon (1799) — which denied any right of contribution among joint tortfeasors — still applies. Modern law in both England and India recognises this right, apportioned according to each wrongdoer's actual degree of responsibility, not divided equally regardless of fault.
