FACTS

Concerned by reports of religious conversions obtained through inducement, deception, or coercion among economically and socially vulnerable communities, the Madhya Pradesh Legislature enacted the Madhya Pradesh Dharma Swatantrya Adhiniyam, 1968, which prohibited conversion from one religion to another "by force or by allurement or by fraudulent means", made contravention a punishable offence, and required every person performing or facilitating a conversion to give prior intimation to the district magistrate. The Orissa Legislature had enacted a similarly worded statute, the Orissa Freedom of Religion Act, 1967. Rev. Stainislaus, a Roman Catholic priest carrying out religious and pastoral work in Madhya Pradesh, was proceeded against under the State Act; he challenged its constitutional validity before the Madhya Pradesh High Court, which upheld the Act. A separate challenge to the Orissa Act had earlier been accepted by the Orissa High Court, which had struck down that State's law as exceeding legislative competence and infringing Article 25. Given the conflicting High Court decisions and the significant implications for both religious freedom and the constitutional distribution of legislative power between the Union and the States, appeals concerning both statutes were heard together by a Constitution Bench of the Supreme Court.

JUDGEMENT

The Supreme Court dismissed the appeals and upheld the constitutional validity of both the Madhya Pradesh Dharma Swatantrya Adhiniyam, 1968 and the Orissa Freedom of Religion Act, 1967, thereby reversing the Orissa High Court's contrary decision on that State's Act. It held that the right to propagate religion under Article 25(1) does not include a right to convert another person, so that the prohibition on conversion by force, fraud, or allurement did not infringe that right at all. It held that both Acts were validly enacted by the respective State Legislatures under Entry 1 of List II ("public order"), rejecting the argument that the subject-matter required resort to Parliament's residuary legislative power. The prosecution against Rev. Stainislaus under the Madhya Pradesh Act was accordingly allowed to proceed on the footing that the underlying statute was constitutionally valid.
