FACTS

Rattan Lal, a 16-year-old resident of Palwal in Gurgaon District, committed house trespass and attempted to outrage the modesty of a seven-year-old girl. A Magistrate convicted him under Sections 451 (house trespass) and 354 (assault or criminal force to outrage modesty) of the Indian Penal Code, sentencing him to six months' rigorous imprisonment on each count (running concurrently) and a fine of Rs. 200 under Section 451, with a further two months' imprisonment in default of payment.

At the time of his trial-court conviction, the Probation of Offenders Act, 1958 — which allows courts to release certain young or first-time offenders on probation instead of imposing imprisonment, and specifically directs that offenders under 21 not be imprisoned unless the court finds it inappropriate not to do so given the offence's nature and the offender's character — had not yet been extended to Gurgaon District. The Act was brought into force there on 1 September 1962, after his conviction but before his appeal was finally decided, raising the question of whether the appellate court could now apply its benefit to him.

ANALYSIS

  • Subba Rao J., for the majority, held that Section 11(1) of the Probation of Offenders Act permits an order under the Act to be made by any court empowered to try and sentence the offender to imprisonment, including an appellate or revisional court when the matter comes before it — the subsection does not restrict appellate jurisdiction only to cases where the trial court itself could have made such an order at the time of conviction.

  • On Article 20(1), Subba Rao J. held that its prohibition is specifically against ex post facto laws that retrospectively create a new offence or increase the penalty beyond what the law in force at the time of the offence allowed — it says nothing about, and does not prohibit, an ex post facto law that merely "mollifies the rigour" of the criminal law by reducing punishment or offering a more lenient disposal such as probation.

  • Raghubar Dayal J., dissenting, took a narrower view specifically on the appellate-jurisdiction question: once a person has already been found guilty by a trial court that itself lacked the power to apply the Act's probation provisions (because the Act had not yet been extended to that area), an appellate or revisional court cannot subsequently invoke Section 11 to grant that benefit — in his view, the appellate court's power under Section 11 was meant to mirror, not exceed, the power the trial court itself could have exercised at the relevant time.

JUDGEMENT

By majority (Subba Rao and Das Gupta JJ.; Raghubar Dayal J. dissenting on the appellate-jurisdiction point), the Supreme Court held that the appellate court could and should apply the benefit of the Probation of Offenders Act, 1958 to Rattan Lal, notwithstanding that the Act came into force in the relevant district only after his trial-court conviction, since doing so reduced rather than increased his punishment and therefore did not violate Article 20(1).

CONCLUSION

Rattan Lal established the enduring principle that Article 20(1)'s ex post facto protection is a one-way shield protecting the accused against retrospective harm, not a bar on retrospective leniency — courts and legislatures remain free to extend beneficial changes in criminal law to pending cases and even to convictions already under appeal. This principle is regularly invoked whenever a more lenient sentencing law, probation scheme, or reduced penalty provision is enacted after an offence but before the final disposition of the case.
