FACTS

Randhir Singh worked as a driver-constable in the Delhi Police force. He discovered that drivers performing substantially the same duties in other government departments and establishments were placed in a higher pay scale than drivers employed in the police force, even though the nature and difficulty of the work was essentially comparable across these different postings. He filed a writ petition before the Supreme Court, contending that this disparity in pay for essentially similar work amounted to unconstitutional discrimination. The Union of India resisted the claim primarily on the ground that "equal pay for equal work" is not a Fundamental Right anywhere named in Part III of the Constitution — it appears only as a Directive Principle under Article 39(d), and Article 37 expressly bars any Directive Principle from being enforced by a court.

  • Justice D.A. Desai, writing for the Court, accepted at the outset that "equal pay for equal work" is not expressly declared to be a Fundamental Right anywhere in Part III of the Constitution — it is Article 39(d), a Directive Principle, that states this goal in so many words.

  • Applying this to the facts, the Court found that Randhir Singh's duties as a driver-constable were substantially the same as those of drivers in other government establishments drawing a higher scale, and that no rational justification for the pay disparity, beyond the accident of departmental placement, had been shown.

JUDGEMENT

The Supreme Court held that the principle of equal pay for equal work, while not a Fundamental Right in itself, is deducible from Articles 14 and 16 and can therefore be enforced through them. The Court directed that Randhir Singh be placed in the same pay scale as drivers performing substantially similar duties in other government establishments, with effect from an appropriately specified date.

CONCLUSION

Randhir Singh is the cleanest textbook illustration of a Directive Principle becoming indirectly enforceable by being absorbed into the meaning of an enforceable Fundamental Right — precisely the mechanism examined in this unit's third post, applied here to Article 39(d) rather than to Article 21 as in Unni Krishnan or Olga Tellis. The principle it established generated a substantial line of later government-service litigation on pay parity between comparable posts, and remains the first case any student should cite when a question specifically asks about Article 39(d) or about "equal pay for equal work" as a constitutional principle.
