FACTS

Following credible allegations of large-scale misappropriation and mismanagement of funds in Bharat Insurance and several related concerns belonging to the Dalmia-Jain group of companies, the Central Government, exercising its power under Section 3 of the Commissions of Inquiry Act, 1952, issued a notification dated 11 December 1956. This notification appointed a one-man Commission of Inquiry, headed by a retired judge (named as the respondent, Justice S.R. Ram Krishna Dalmia challenged this notification by a petition under Article 32, arguing on two distinct grounds.   • On the challenged clause of the notification, however, the Court held that the Commissions of Inquiry Act, 1952 only empowered the Government to direct a Commission to inquire into and report on a defined matter — it did not authorise the Government to direct the Commission to also recommend the "redress or punishment" of persons found responsible, since the Act envisaged a fact-finding and reporting body, not one clothed with a mandate to propose punitive outcomes. JUDGEMENT

The five-judge bench unanimously upheld the constitutional validity of Section 3 of the Commissions of Inquiry Act, 1952, holding that it did not confer arbitrary or unguided discretion of the kind that had proved fatal in Anwar Ali Sarkar. Ram Krishna Dalmia stands alongside Anwar Ali Sarkar as one of the two foundational pillars of Article 14 classification jurisprudence — while Anwar Ali Sarkar showed what happens when no real differentia exists at all, this case supplied the durable, positive formulation of what a valid one requires: an intelligible differentia with a rational nexus to the law's object. Its clear holding that even a single individual or a narrow, specifically-named group can be validly classified by itself, provided real facts justify it, remains directly relevant whenever the State takes targeted action — a specific tax assessment, a specific regulatory inquiry, a specific licensing decision — against one person or a small group rather than an entire class, since the question is never the size of the class but the genuineness of the distinguishing facts.
