Qui facit per alium facit per se means "he who acts through another acts himself." It is the maxim underlying vicarious liability — the law treats an employer as though the employee's authorised acts were the employer's own.
When a company instructs a delivery rider to transport goods and the rider negligently causes an accident while making the delivery, the company is treated as though it had itself carried out the delivery — because the rider was acting on the company's behalf, within the very task the company set in motion.
Unit 2, Post 2 on Vicarious Liability, cited as the doctrinal foundation for holding an employer liable for an employee's tort.
Don't read this maxim as making an employer liable for absolutely anything an employee does. It only explains why liability transfers for acts done within the course of employment — a wholly personal act by the employee, disconnected from the assigned work, is not something the employer is treated as having done "through" the employee at all.
