FACTS

This case arose from a reference made by the three-judge bench in Society for Unaided Private Schools of Rajasthan v. Union of India (2012), which called for a Constitution Bench to authoritatively examine the validity of two constitutional amendments. Multiple petitions, led by Pramati Educational and Cultural Trust and various other educational trusts, challenged the Constitution (Ninety-third Amendment) Act, 2005, which inserted Article 15(5) permitting reservation for socially and educationally backward classes, SCs, and STs in private educational institutions (including unaided, non-minority ones), and the Constitution (Eighty-sixth Amendment) Act, 2002, which inserted Article 21A.

The petitioners argued that Article 15(5) violated Article 19(1)(g) by imposing a reservation mandate even on unaided institutions, and that Sections 12(1)(c) and 18 of the RTE Act (giving effect to Article 21A) would force minority institutions — whether aided or unaided — to admit non-minority students under the disadvantaged-group quota and to conform to State-prescribed curricula and recognition norms, thereby diluting their distinct religious or linguistic character and violating their right under Article 30(1) to establish and administer educational institutions of their choice.

  • On the minority-institution question, the Court held that Article 30(1)'s guarantee is itself a facet of the basic structure, and that applying RTE provisions compelling minority institutions to reserve seats for non-minority students or conform strictly to State-prescribed curricula would materially dilute their distinct religious or linguistic character, undermining the very purpose Article 30(1) protects.

JUDGEMENT

The Constitution Bench unanimously upheld the validity of the 93rd Amendment (Article 15(5)) and the 86th Amendment (Article 21A) as consistent with the basic structure, and held that the RTE Act, 2009 is inapplicable to all minority educational institutions — aided or unaided — protected under Article 30(1), while remaining fully applicable to government, aided, and unaided non-minority institutions.

Notably, the Supreme Court has more recently referred the correctness of Pramati's minority-institution exemption for reconsideration by a larger Constitution Bench, reflecting ongoing debate about whether this exemption strikes the right balance between minority rights and every child's right to education — so while Pramati remains the current governing law, this is an area worth watching for future developments.
