FACTS

Phulavati's father, a coparcener in a Mitakshara joint Hindu family, died in 1988 — well before the Hindu Succession (Amendment) Act, 2005 came into force. Phulavati filed a suit for partition in 1992, before the amendment existed. During the pendency of the proceedings, after the 2005 Amendment came into force, she sought to amend her claim to assert an enhanced coparcenary share under the newly amended Section 6, on the footing that the amendment operated retroactively regardless of when her father had died.

ANALYSIS

  • The Bench read the words "on and from the commencement of the Hindu Succession (Amendment) Act, 2005" in Section 6(1) as showing that Parliament intended the new coparcenary right to be available only to living daughters of living coparceners as on that date.

JUDGEMENT

The Supreme Court held that Section 6, as amended, benefits only a daughter whose father-coparcener was himself alive on 9 September 2005 — a "living coparcener" requirement. Since Phulavati's father had died in 1988, well before that date, her claim to an enhanced coparcenary share under the amended provision could not succeed.

CONCLUSION

Phulavati stood as the governing law on Section 6 for five years, until Vineeta Sharma v. Rakesh Sharma (2020) expressly overruled its "living coparcener" requirement, holding that a daughter's right arises by birth and does not depend on her father surviving to 2005. Phulavati remains essential study precisely because it shows the restrictive reasoning the Supreme Court itself later had to reject.
