FACTS

Pradeep Kumar Biswas and other employees of the Indian Institute of Chemical Biology — a unit of the Council of Scientific and Industrial Research (CSIR) — had their services terminated and sought to invoke writ jurisdiction, which required establishing that CSIR was "State" under Article 12. The Calcutta High Court had dismissed their petition, following the 1975 precedent in Sabhajit Tewary v. Union of India, which had held CSIR was not "State."

JUDGEMENT

By a 5:2 majority, the Supreme Court held CSIR to be "State" under Article 12, expressly overruling Sabhajit Tewary v. Union of India (1975), and reformulating the test for Article 12 "authorities" going forward.
