FACTS

In preparation for the 1982 Asian Games (Asiad) in Delhi, the Union of India, the Delhi Administration, and the Delhi Development Authority commissioned a number of large construction projects — stadia, flyovers, and allied works — executed not directly by these public bodies but through private building contractors, who in turn engaged workmen, often through intermediate jamadars and sub-contractors, drawn largely from among the rural poor and migrant labour. The People's Union for Democratic Rights (PUDR), a civil liberties organisation, commissioned two of its members to investigate the actual working and living conditions of these labourers on the Asiad sites. Their investigation, reduced to a detailed report, found that workmen were being paid daily wages considerably below the minimum wage fixed under the Minimum Wages Act, 1948; that women workers engaged in the same construction work as men were being paid a lower daily wage than men, contrary to the Equal Remuneration Act, 1976; that children below the age of fourteen years were being employed directly on construction work, in apparent violation of the Employment of Children Act, 1938; that the provisions of the Contract Labour (Regulation and Abolition) Act, 1970 and the Inter-State Migrant Workmen Act, 1979 (governing registration of contractors, licensing, and welfare amenities such as drinking water, latrines, and first aid) were being systematically disregarded; and that the labourers were living in makeshift jhuggis at the work sites in conditions of considerable hardship. Rather than filing a formally drafted writ petition through counsel, PUDR wrote directly to Justice P.N. Bhagwati of the Supreme Court, enclosing this report and requesting the Court's intervention. The letter was placed before the Court and treated as a writ petition invoking the Supreme Court's jurisdiction under Article 32, with the Union of India, the Delhi Administration, and the Delhi Development Authority impleaded as respondents.

JUDGEMENT

The Supreme Court allowed the writ petition. It held that the letter from PUDR was validly maintainable as a writ petition under Article 32, and that PUDR had the standing to bring the grievances of the Asiad workmen before the Court. On the merits, the Court held that the non-payment of the statutory minimum wage to the workmen amounted to a violation of Article 23, that this violation was directly attributable not only to the contractors who actually engaged the workmen but also to the Union of India, the Delhi Administration, and the Delhi Development Authority as the principal employers responsible for the project, and that Article 23 could be enforced against the contractors as private individuals notwithstanding that it did not refer to "the State". The Court further held that paying women workers less than men for identical work violated the constitutional guarantee of equality and the Equal Remuneration Act, 1976, and that the employment of children below fourteen years on the construction sites, if established, violated Article 24. The Court issued a series of directions requiring the Union of India, the Delhi Administration, and the Delhi Development Authority to take immediate and effective steps to ensure that the minimum wage was actually paid to every workman, that women received equal wages for equal work, that children below the prescribed age were not employed, and that the welfare provisions of the Contract Labour (Regulation and Abolition) Act, 1970 and other applicable labour legislation were genuinely observed at the Asiad work sites, with continuing supervision to secure compliance.

CONCLUSION

People's Union for Democratic Rights v. Union of India remains one of the most significant early Public Interest Litigation judgments in Indian constitutional history, alongside cases like Bandhua Mukti Morcha v. Union of India decided soon after. Its interpretation of "forced labour" under Article 23 — extending "force" to include economic compulsion arising from poverty and sub-minimum wages — has been consistently followed in subsequent labour-rights litigation, and its holding that Article 23 binds private individuals as well as the State remains a standard illustration, in every constitutional law course, of a Fundamental Right deliberately drafted to reach beyond State action. Its recognition of a principal employer's continuing responsibility for labour conditions on projects it sponsors, even where work is executed through contractors, has also influenced how courts approach liability in large public infrastructure and welfare projects more generally.
