FACTS
The case arose out of a criminal prosecution launched by the defendant against the plaintiff, which ultimately ended in the plaintiff's acquittal or discharge. JUDGEMENT
The Full Bench of the Allahabad High Court authoritatively laid down that a plaintiff suing for malicious prosecution must prove, cumulatively: (i) that he was prosecuted by the defendant; (ii) that the prosecution terminated in the plaintiff's favour; (iii) that the prosecution was instituted without reasonable and probable cause; (iv) that the defendant was actuated by malice; and (v) that the plaintiff suffered damage as a result. This five-fold statement of the essentials of the tort became, and has remained, the settled formulation applied by Indian courts.

Pandit Gaya Parshad Tewari v.
