FACTS
The defendant was the owner and driver of a jeep. A person travelling in the jeep as a gratuitous passenger, having accepted a free lift, was killed when, while the jeep was being driven at an ordinary speed on a proper road, its right front wheel suddenly came off. The sudden loss of the wheel caused the jeep to swerve and overturn, resulting in fatal injuries to the passenger.
