FACTS

The defendant's ship, the Wagon Mound, was taking on furnace oil at a wharf in Sydney Harbour when, owing to the negligence of the ship's crew, a large quantity of the oil was allowed to spill and discharge into the harbour. The oil drifted across the water and accumulated near the plaintiff's wharf, where welding work was being carried out on another vessel at the time. On being informed by his manager that furnace oil does not easily ignite when spread on water, the plaintiff's manager permitted the welding work to continue. During the welding operations, molten metal fell from the vessel onto cotton waste that was floating in the oil on the surface of the water. This ignited the cotton waste, which in turn set the floating oil alight, causing an extensive fire that spread rapidly and destroyed the plaintiff's wharf along with equipment and other property on it.

  • The Privy Council rejected the "directness" test laid down in Re Polemis & Furness, Withy & Co (1921), under which a defendant was held liable for all direct consequences of their negligent act, regardless of whether those consequences were foreseeable.

JUDGEMENT

The Privy Council held that, since the outbreak of fire was not a reasonably foreseeable consequence of the oil spillage, the defendant was not liable for the fire damage — even though the oil spillage was admittedly negligent, and the fire was, in fact, a direct physical consequence of it.

CONCLUSION

Wagon Mound (No. 1) is the landmark case that replaced the "directness" test of Re Polemis with the modern "reasonable foreseeability" test for remoteness of damage in negligence. By establishing, for the first time, that a negligent defendant is liable only for the kind of damage that a reasonable person could have foreseen — and not for every consequence that directly flows from the negligent act — this case fundamentally reshaped the law on remoteness, and the test it originated remains the settled law on this question in India and throughout the Commonwealth.
