FACTS

Olga Tellis, a journalist, and a large group of pavement and slum dwellers in Bombay filed writ petitions after the Bombay Municipal Corporation, acting under Section 314 of the Bombay Municipal Corporation Act, 1888, announced its intention to demolish pavement and slum dwellings across the city and deport the occupants to their places of origin, citing overcrowding and unsanitary conditions on public footpaths. The petitioners argued that they were desperately poor migrants who lived on pavements specifically because these locations were close to their places of casual, daily-wage employment — losing this precise location would mean losing their livelihood entirely, since they could not afford commuting costs to a job from anywhere further away, and losing their livelihood, they argued, was equivalent to losing their lives in the fullest constitutional sense. The Corporation contended that footpaths and pavements are public property meant for pedestrian passage, that no one has any right to encroach upon them, and that removal of unauthorised structures was a routine and lawful exercise of municipal power.

  • On the encroachment question, however, the Court held that this expansive reading of Article 21 did not create any right to occupy public property unlawfully — pavements and footpaths exist for public passage, no citizen has a Fundamental Right to encroach on them, and the Corporation's power under Section 314 to remove unauthorised structures was itself valid, existing "procedure established by law."

JUDGEMENT

The Supreme Court held that the right to life under Article 21 includes the right to livelihood, and that Section 314 of the Bombay Municipal Corporation Act constituted valid "procedure established by law" for removing unauthorised pavement encroachments. The Corporation's power to evict was upheld, but the Court directed that eviction not take place until after the monsoon, and that pavement and slum dwellers enumerated in the 1976 census be considered for alternative sites under the government's existing rehabilitation scheme before removal.

CONCLUSION

Olga Tellis stands alongside Unni Krishnan as one of the two most cited illustrations of Directive Principles expanding the content of Article 21 through harmonious construction — here supplying the "right to livelihood," there the "right to education." It also usefully demonstrates that harmonious construction is not a one-sided tool that always favours the individual: the same judgment that expanded Article 21's meaning also upheld the State's power to remove an unlawful encroachment, showing that reading Part III and Part IV together produces a genuinely balanced result, not an automatic victory for whichever party invokes a Directive Principle.
