FACTS

The matter arose out of a claim for compensation under Section 166 of the Motor Vehicles Act, 1988, filed by the dependants of a person who died in a motor accident. The central dispute concerned how "just compensation" ought to be computed — in particular, whether, and how, an addition for "future prospects" (an amount added for the deceased's anticipated future increase in income, before applying the multiplier) should be made where the deceased was self-employed or on a fixed salary, as distinct from a person in permanent, salaried employment with regular prospects of increments. JUDGEMENT

The Constitution Bench settled the law by directing that future-prospects addition be granted uniformly to permanently employed, self-employed, and fixed-salary deceased persons alike, according to the age-bracket formula of 40%, 25%, and 10% set out above, and by fixing standardised, periodically revisable amounts for the conventional heads of loss of estate, loss of consortium, and funeral expenses. It affirmed the Sarla Verma multiplier method for computing pecuniary loss of dependency, and directed that all Motor Accident Claims Tribunals and courts compute compensation in motor accident death claims in accordance with this unified formula, overruling the inconsistent approaches taken in earlier decisions to the extent they conflicted with it.
