Narmada Bachao Andolan v. Union of India (2000)

The Sardar Sarovar Dam case, in which a divided Supreme Court applied sustainable development to permit a major infrastructure project to continue, conditioned on step-by-step rehabilitation of displaced families.

FACTS

The Sardar Sarovar Dam on the Narmada river was a large, multi-State river-valley development project spanning Gujarat, Madhya Pradesh and Maharashtra, sanctioned following an award of the Narmada Water Disputes Tribunal and intended to provide irrigation, drinking water and hydroelectric power, with construction beginning in 1987 following environmental clearance from the Union Government. Narmada Bachao Andolan, a people's movement representing communities to be displaced by the rising reservoir, filed a writ petition in 1994 challenging further construction, arguing that the environmental clearance had been granted without complete environmental impact studies and that rehabilitation and resettlement of the thousands of tribal and other project-affected families had not been adequately planned or executed ahead of submergence at each successive height of the dam. By the time the matter reached final hearing, the dam had already been under construction for well over a decade and had reached a substantial height.

ISSUES

  1. Whether the project's environmental clearance, granted without complete environmental impact studies at the time, was valid, and whether construction could continue in their absence.
  2. Whether rehabilitation and resettlement of project-affected persons had been adequately planned and implemented to justify allowing further submergence and construction.
  3. Whether the doctrine of laches — unexplained delay in approaching the Court, given years had passed since the project's approval and substantial construction — barred the relief sought.
  4. How the competing considerations of large-scale developmental benefit against displacement and ecological disruption should be balanced under the principle of sustainable development.

ANALYSIS

  • The majority held that once the Union Government had granted environmental clearance in 1987 on a conditional basis, meant to be worked out alongside the project's progress rather than requiring every study to be complete before any construction, and given the Tribunal award and years of executive scrutiny behind it, it was not for the Court to re-appraise the environmental wisdom of the project as if sitting in appeal over an expert executive decision — judicial review of such policy is limited to whether the decision-making process followed law, not whether the decision itself was the best possible one.
  • On rehabilitation, the majority held that the Tribunal's award already contained a comprehensive R&R scheme requiring resettlement to proceed pari passu (step by step) with the dam's rising height — meaning construction to any given height could proceed once R&R for the population displaced at that height was completed, not that all eventual R&R had to precede any construction at all — and directed continuous monitoring by each State's Grievance Redressal Authority to verify this condition before any further height increase.
  • On laches, the majority found the petition suffered considerable delay, filed years after clearance and after substantial construction and expenditure had already occurred, and treated this reliance interest as a factor weighing against a wholesale reconsideration of the project's basic validity at this late stage.
  • Justice Bharucha's dissent took the opposite view on the facts, holding that the scale of the project's demonstrated environmental and human consequences meant relief should not be denied merely because of delay or because construction had already progressed, and that the rehabilitation actually documented on the ground was inadequate to the scale of displacement, warranting a more cautious approach.

JUDGEMENT

By a 2:1 majority, the Supreme Court permitted the Sardar Sarovar Dam's construction to continue up to its full sanctioned height, but only in stages, with each stage of height increase conditioned on the Relief and Rehabilitation Sub-Group's certification that rehabilitation for that stage's displaced persons had been completed, and subject to continued monitoring and periodic reporting by the Grievance Redressal Authorities. Justice Bharucha dissented, favouring a more restrictive approach pending fuller demonstration of adequate rehabilitation.

CONCLUSION

Narmada Bachao Andolan remains the leading Indian illustration of a court applying the principle of sustainable development to reconcile a major infrastructure project with environmental and human-displacement concerns, rather than treating development and environmental protection as always mutually exclusive; it is also frequently cited for its treatment of laches in public interest litigation and for the pari passu rehabilitation-monitoring model it established, later used in other large infrastructure disputes. Its 2:1 split, rather than a unanimous outcome, is a detail exam answers often miss and is worth remembering precisely.
