FACTS
Shriram Foods and Fertiliser Industries, a unit of Delhi Cloth Mills Ltd., operated a caustic chlorine plant in the densely populated Kirti Nagar area of Delhi. On 4 December 1985, a major leakage of oleum gas occurred from one of the units of the plant, causing widespread panic in the surrounding locality. Within two days, on 6 December 1985, there was a further, minor leak of the same gas from a joint in a pipe. The escape resulted in the death of an advocate practising in the Tis Hazari courts and caused several other persons to be hospitalised, affecting a large number of residents in the vicinity. A writ petition originally filed by M.C. Mehta seeking closure of the plant on account of the earlier hazards it posed was already pending before the Supreme Court when the oleum gas leak occurred, and applications for interim compensation for the victims of the leak were made in that pending proceeding.

JUDGEMENT
The Supreme Court laid down the rule of absolute liability, holding that where an enterprise is engaged in a hazardous or inherently dangerous activity and harm results to anyone on account of an accident in the operation of that activity, the enterprise is strictly and absolutely liable to compensate all those who are affected by the accident, and that such liability is not subject to any of the exceptions recognised under the rule in Rylands v.
