FACTS

M.C. Mehta, an environmental lawyer and public interest litigant, filed a writ petition under Article 32 of the Constitution after a 1985 incident in which chemicals discharged into the river Ganga at Haridwar caught fire and burned for over thirty hours, dramatising the extent of industrial contamination the river was already suffering. The petition focused particularly on the river's condition at Kanpur, where numerous leather tanneries operating at Jajmau, on the banks of the Ganga, were discharging trade effluent containing toxic chemicals and heavy substances directly into the river, largely without any effluent treatment. The petition also alleged that the Kanpur Municipal Corporation was failing to adequately treat domestic sewage before its discharge into the river, compounding the industrial pollution with untreated municipal waste, and that the resulting contamination was directly responsible for widespread illness and death among the population relying on the river for water. The petitioner sought directions restraining the tanneries from discharging untreated effluent and directing the Municipal Corporation to set up adequate sewage treatment facilities, invoking both the constitutional right to life under Article 21 and the regulatory framework of the Water (Prevention and Control of Pollution) Act, 1974, under which the tanneries required consent from the State Pollution Control Board that many had never properly obtained or were operating in breach of.

ANALYSIS

  • Venkataramiah, J., writing for the Bench, held that although the tanneries were private parties, water pollution of the river Ganga affecting the health and life of a very large population squarely engaged Article 21's guarantee, and a writ petition under Article 32 was maintainable to compel effective action by both the polluting industries and the public authorities (the State Pollution Control Board and the Municipal Corporation) whose statutory duty it was to prevent and remedy such pollution — the Court would not confine itself to only directing the State to act, but would also directly restrain the private polluters themselves.

  • On the tanneries' economic-importance argument, the Court held that the financial capacity of an industry to arrange for the treatment of effluent before its discharge is not a factor relevant for deciding whether it should be allowed to continue operating — a tannery that could not afford treatment facilities and yet continued polluting would have to stop production rather than continue causing harm, since the right of local residents to life and clean water could not be subordinated to the industry's continued profitability. This directly applies the reasoning later echoed in Vellore Citizens Welfare Forum (1996): economic value cannot excuse the continued destruction of environmental and public health.

  • The Court also directed the Kanpur Municipal Corporation to take immediate steps to set up sewage treatment works and intermediate measures, holding that municipal inaction in treating domestic sewage was a distinct and independently actionable failure of statutory duty, running alongside the tanneries' industrial pollution rather than excusing it — both sources of pollution had to be addressed, not merely the more visible industrial one.

JUDGEMENT

The Supreme Court directed the tanneries at Jajmau, Kanpur to set up primary effluent treatment plants within the time allowed, failing which they would be directed to stop their business and close down; it clarified that the financial incapacity of a tannery to comply was not a valid excuse to continue polluting the river. The Court directed the Kanpur Municipal Corporation to take immediate action to establish sufficient sewage treatment facilities, and directed the State Government and the State Pollution Control Board to ensure compliance and report on the progress of these measures. The Court retained the matter for further monitoring, in a manner that anticipated the continuing-mandamus approach later formalised in Godavarman.

CONCLUSION

The Ganga Pollution Case is remembered less for creating a new legal doctrine than for proving that PIL under Article 32 could be used to force real, on-the-ground enforcement of an existing regulatory statute (the Water Act, 1974) against powerful, economically important private industry, at a time when State Pollution Control Boards had shown themselves largely unable or unwilling to enforce consent conditions against politically influential polluters. It established the template — economic importance is not a defence, statutory non-compliance justifies closure, and the Court will retain supervisory jurisdiction until compliance is actually achieved — that both Vellore Citizens Welfare Forum (1996) and the Godavarman forest litigation later built upon and refined.
