Azan is an essential part of Islamic prayer — but using a loudspeaker to broadcast it is not. This case tested whether environmental noise rules could validly apply to a religious call to prayer, and drew a sharp line between a religious practice itself and the equipment used to amplify it.

Maulana Mufti Syed Md. Noorur Rehman Barkati, the Imam and Khatib of Tipu Sultan Shahi Masjid in Calcutta, along with eight others, filed a writ petition before the Calcutta High Court. They sought a declaration that Rule 3 (read with Schedule III) of the Environmental (Protection) Rules, 1986 — which sets ambient noise standards — should not apply during Azan, the call to prayer given five times a day from mosques. They argued that applying these noise standards to Azan, which is broadcast using loudspeakers, violated their fundamental rights under Article 25 (freedom of religion) and Article 14 (equality) of the Constitution.

- The court applied the well-established "essential religious practice" test — under Article 25, only practices that are genuinely essential and integral to a religion get constitutional protection from otherwise valid, general laws; practices that are merely a matter of convenience or modern convention do not.

- Applying this test, the court held that Azan itself — the call to prayer — is genuinely essential to Islam and entitled to protection. However, it drew a clear line: using a loudspeaker or amplifier to broadcast that call is a modern technological addition, not something the religion itself requires. Azan can be, and historically was, given without any electronic amplification.

The Calcutta High Court dismissed the writ petition, holding that while Azan is an essential religious practice, the use of loudspeakers and amplifiers to broadcast it is not, and the noise standards under the Environmental (Protection) Rules, 1986 therefore validly applied.

It anticipated, at the High Court level, the same essential distinction the Supreme Court would later apply nationally in Church of God (Full Gospel) in India v. K.K.R. Majestic Colony Welfare Association (2000).
