FACTS

Like Madras, Orissa had its own comprehensive statute for regulating Hindu religious endowments — the Orissa Hindu Religious Endowments Act, 1939, later substantially amended by the Orissa Hindu Religious Endowments (Amendment) Act, 1952. The appellant was the Mahant (head) of two well-known Orissa mutts holding significant landed and other properties dedicated to religious and charitable purposes. Under the amended Act, the Commissioner of Hindu Religious Endowments was empowered, under Sections 38 and 39, to enquire into allegations of mismanagement against a religious institution and, on that basis, to frame or approve a detailed administrative "scheme" governing how the institution's affairs and properties would thereafter be run — a power that, in practice, could result in significant external control over decisions traditionally within the Mahant's own discretion. A proviso to Section 46 similarly extended the regulatory reach of the Act over aspects of the institution's internal financial and administrative arrangements. Separately, Section 49 of the Act required every religious institution with income above a specified threshold to pay an annual monetary contribution to the Commissioner's office, to help meet the cost of the Commissioner's supervisory functions across all endowments in the State. The Mahant challenged Sections 38, 39, the proviso to Section 46, and Section 49 as violating his rights under Article 19(1)(f) (the then-fundamental right to property), Article 25, Article 26, and Article 27. Because the litigation raised questions closely paralleling those in the Madras Act under challenge in the Shirur Mutt case, the two matters were heard together by the same seven-Judge Bench.

  • On the annual contribution, the Court distinguished it from provisions imposing real managerial control, holding that Section 49's levy was correlated to, and calculated to meet, the actual cost of the Commissioner's supervisory and regulatory services rendered to religious institutions generally — because of this direct service-cost correlation, it bore the character of a "fee" rather than a "tax", and, in any event, its object being the secular administration of religious endowments rather than the promotion of any particular religion, it did not fall foul of Article 27.

JUDGEMENT

The Supreme Court held that Sections 38 and 39 and the proviso to Section 46 of the Orissa Hindu Religious Endowments Act, 1939, as amended, were ultra vires Articles 19(1)(f), 25, and 26 of the Constitution and struck them down, while upholding Section 49's annual contribution requirement as a valid fee (or, in any event, a tax not falling within Article 27's prohibition) genuinely correlated to the cost of the State's secular supervisory functions over religious institutions.
