Since only a bench of equal or greater strength could reconsider these two prior larger-bench decisions, a three-judge bench (Chelameswar, Bobde, and Nagappan JJ.) passed an order on 11 August 2015 referring the question of whether privacy is a fundamental right to a Constitution Bench of appropriate strength.
