Swami Kesavananda Bharati, head of the Edneer Mutt in Kerala, challenged provisions of the Kerala Land Reforms Act, as amended, which restricted the mutt's ability to manage its own property, arguing this violated his rights under Article 26 (freedom to manage religious affairs) and Article 31 (the right to property, then still a Fundamental Right). JUDGEMENT
By a wafer-thin majority of 7:6, delivered across eleven separate opinions, the Supreme Court upheld the validity of the 24th Amendment and most of the 25th Amendment, while recognizing for the first time that Parliament's amending power under Article 368 is subject to the basic structure limitation.
