FACTS

Joginder Kumar, a 28-year-old law graduate practising as an advocate, was called to appear before the Senior Superintendent of Police (SSP), Ghaziabad, on 7 January 1994. He appeared along with his brothers at around 10 a.m., after which the SSP kept him in custody. On 9 January 1994, when Kumar's brother and other relatives went to the police station to inquire about his welfare, they were told he had been taken to an undisclosed location — his whereabouts remained unknown, and he was effectively held for roughly five days without any formal arrest record or communication of his location to his family.

Kumar's brother filed a writ petition under Article 32 seeking a writ of habeas corpus for his release and production before the Court. The Supreme Court ordered notice to the State of Uttar Pradesh and the SSP, Ghaziabad, on 11 January 1994. The SSP appeared before the Court on 14 January 1994 and informed it that Joginder Kumar had already been released.

JUDGEMENT

The Supreme Court laid down binding guidelines for the exercise of the power of arrest — requiring genuine, reasoned justification for any arrest rather than mere lawful authority, a right for the arrested person to have a friend or relative informed of the arrest and place of detention, an obligation on police to inform arrested persons of this right, and a corresponding entry in the police diary — and directed the District Judge, Ghaziabad, to inquire into the specific facts of Joginder Kumar's detention.

CONCLUSION

Joginder Kumar established that the mere lawful existence of the power to arrest does not itself justify its exercise — police must act only upon genuine necessity, a principle that curbs arbitrary and routine arrests under ordinary criminal law. Its guidelines on informing a friend or relative of an arrest were substantially reinforced and expanded three years later in D.K. Basu v. State of West Bengal (1997), and both cases together form the foundation of the constitutional and statutory safeguards against custodial abuse that were later substantially codified into criminal procedure law.
