The Constitution (One Hundred and Third Amendment) Act, 2019 inserted clause (6), with an accompanying Explanation, into Article 15, and a parallel clause (6) into Article 16. These provisions permitted the State to make special provision, including reservation of up to 10% of seats or posts, for the advancement of "economically weaker sections" (EWS) of citizens — defined by income and asset criteria to be notified separately by the Government — in admission to educational institutions (including private, unaided institutions other than minority institutions protected under Article 30(1)) and in public employment. Several writ petitions, led by the NGO Janhit Abhiyan, challenged the constitutional validity of the 103rd Amendment on two principal grounds: first, that permitting reservation based purely on economic criteria, with no reference at all to social and educational backwardness, was fundamentally inconsistent with the scheme of Articles 15 and 16 as settled in Indra Sawhney v. Union of India (1992), and damaged the equality code forming part of the Constitution's basic structure; and second, that excluding SC, ST, and OBC citizens from this new quota — even though genuinely poor individuals exist within these communities too — was itself arbitrary and discriminatory. Because the challenge raised a fundamental question about the basic structure, the matter was heard by a five-judge Constitution Bench.

JUDGEMENT
