Rameshwar Prasad and his brother Babu Partab Singh were members of a Hindu joint family. In 1912, the two of them executed two sale deeds, together transferring the family's one-third share in a village (mauza Kashipur) — property that had originally been purchased in 1864 in the name of Rameshwar Prasad's mother. Their intention was to use the sale proceeds to buy other family land in a more convenient, accessible location. After the death of Rameshwar Prasad, his two sons, Jagat Narain and Krishna Narain, sued to set aside the 1912 sales, arguing that this kind of sale — made to relocate the family's holding rather than out of any pressing necessity — was not something Hindu law allowed a manager to do without the other coparceners' consent.

- The Full Bench reviewed earlier Privy Council decisions and found they had never given "benefit of the estate" a fixed, narrow meaning — some of them wrongly treated it as if it only meant purely defensive acts (like saving property from a threatened loss).
