FACTS

Following the introduction of Article 31B by the First Amendment in 1951, Parliament progressively expanded the Ninth Schedule over subsequent decades to include a growing and increasingly diverse range of statutes, well beyond the original agrarian-reform legislation the Schedule was created to protect — by the time of this litigation, it contained close to 300 entries. This case arose from challenges to specific laws inserted into the Ninth Schedule by later constitutional amendments, including the Tamil Nadu Janman Estates (Abolition and Conversion into Ryotwari) Act and the West Bengal Land Holding Revenue Act, 1979, inserted respectively by the Thirty-Fourth and Sixty-Sixth Amendments. The petitioners argued that these laws, whatever their formal Ninth Schedule protection, in substance violated core Fundamental Rights, and questioned whether Parliament could insulate any law whatsoever from all judicial scrutiny of its consistency with Fundamental Rights simply by placing it in the Schedule, given that the basic structure doctrine established in Kesavananda Bharati v. State of Kerala (1973) placed limits on Parliament's amending power itself. Given the scale of the constitutional question — whether Article 31B's blanket immunity could itself be reconciled with the basic structure doctrine — a 5-Judge Bench in 1999 referred the matter to a larger Bench, and it was ultimately heard and decided by a 9-Judge Constitution Bench.

JUDGEMENT

The nine-Judge Bench unanimously held that Article 31B does not confer blanket, permanent immunity on every Ninth Schedule law from all judicial review. Laws inserted into the Ninth Schedule before 24 April 1973 remain fully protected and beyond challenge. Laws inserted after that date are open to challenge if they violate Fundamental Rights (particularly Articles 14, 19, and 21), applying a two-stage test: first, whether the Fundamental Rights violation is established, and second, whether that violation is severe enough to damage or destroy the basic structure of the Constitution. The Court reaffirmed and applied the basic structure doctrine of Kesavananda Bharati v. State of Kerala to this specific context of Ninth Schedule protection.
