Instrumentality of the State (రాజ్య ఇన్‌స్ట్రుమెంటాలిటీ)

A body that is not literally a government department, but is treated as "State" under Article 12 because it is financially, functionally, or administratively dominated by government — a theory first proposed by Justice Mathew in Sukhdev Singh v. Bhagatram Sardar Singh Raghuvanshi (1975).

Real-life example

ONGC, LIC, and CSIR have all been held to be instrumentalities of the State, even though each is structured as a separate corporation or society.

Common mix-up

Not every government-linked body qualifies — BCCI, despite its public importance, was held NOT to be an instrumentality of the State in Zee Telefilms Ltd. v. Union of India (2005), because government control over it was merely regulatory, not deep and pervasive.
