On 13 August 1990, the V.P. Singh government issued an Office Memorandum (OM) implementing the Mandal Commission's 27% OBC reservation recommendation for civil posts and services under the Government of India. This announcement triggered nationwide protests and political upheaval, and the Supreme Court granted an interim stay on its implementation. Before the matter could be finally heard, the successor P.V. Narasimha Rao government issued a second OM on 25 September 1991, which modified the scheme in two significant ways: first, it directed that preference within the 27% OBC quota be given to poorer sections of OBCs based on economic criteria; and second, and more controversially, it introduced a separate, additional 10% reservation for "other economically backward sections of the people" who were not covered by any existing reservation — in substance, a reservation for poorer members of forward/upper castes, based purely on economic criteria with no reference to caste or social backwardness at all.

Numerous writ petitions (led by Indra Sawhney) were filed under Article 32 challenging both OMs — the 1990 OM's 27% OBC reservation on one set of grounds, and the 1991 OM's economic-criteria-based additional 10% quota on an entirely different set of grounds. Because the case required reconsidering several earlier decisions on Article 16(4) (including M.R. Balaji, Devadasan, and Chitralekha), it was referred to and finally heard by a specially constituted nine-judge Constitution Bench — the largest bench to consider the reservation question up to that point.
