FACTS

JUDGEMENT
The Supreme Court held that service rendered to a patient by a medical practitioner, by way of consultation, diagnosis, and treatment, both medicinal and surgical, falls within the ambit of "service" under Section 2(1)(o) of the Consumer Protection Act, 1986 (the corresponding modern definition of "service" is retained under Section 2(42) of the Consumer Protection Act, 2019), except where the service rendered is free of charge, or is rendered under a contract of personal service. Consequently, a patient who hires or avails such service for consideration is a "consumer", and a consumer forum has jurisdiction to entertain a complaint alleging medical negligence notwithstanding the existence of separate professional disciplinary machinery.

Indian Medical Association v. V.P. Shantha is the foundational authority bringing the entire medical profession within the reach of Indian consumer law, and it remains the starting point for every subsequent case involving deficiency in medical service — including Spring Meadows Hospital v. Harjot Ahluwalia, examined elsewhere in this unit's Case-Law list. By rejecting the argument that professional, skill-based services stand outside "service" merely because they involve specialised judgement, the decision confirmed that the touchstone for consumer protection is not the nature of the provider's occupation but whether a service was rendered for consideration — a principle that has since been applied, on the same reasoning, to banks, insurers, and a wide range of other professional and institutional service providers discussed throughout this unit.
