FACTS

A will was propounded that excluded certain natural heirs and conferred substantial benefits on persons closely associated with its preparation and execution. Those challenging the will questioned the circumstances surrounding its execution, including aspects of the testator's condition at the relevant time and the propounder's own close involvement in preparing the document. The matter reached the Supreme Court on the question of the correct legal standard for proving a contested will.

ANALYSIS

JUDGEMENT

The Supreme Court laid down that a will must be proved like any document, on the ordinary civil standard, but that the propounder carries a special, additional duty to remove any suspicious circumstances surrounding its execution — mere proof of due execution in a formal sense is not sufficient wherever genuine suspicion attaches to the document.
