Free Legal Aid Cell Shri Sugan Chand Aggarwal v. Govt. of NCT of Delhi (2001) (Landmark Case)

The right to life under Article 21 includes the right to live in an environment free from excessive noise. This Delhi High Court decision recognised noise itself as a pollutant harmful enough to violate a fundamental right, and backed that recognition with concrete enforcement directions.

FACTS

An association of public activists filed a public interest petition before the Delhi High Court. Their grievance was twofold: first, the display and bursting of fireworks during festivals and weddings caused physical and mental harm to adults and children alike; second, the indiscriminate and largely unchecked use of loudspeakers at religious places and social functions had made noise pollution a routine, everyday affliction on the health of ordinary citizens, with no effective mechanism actually stopping it.

ISSUES

i. Does noise, beyond a reasonable limit, qualify as "pollution" that can violate the fundamental right to life under Article 21 of the Constitution?
ii. What practical mechanism can courts put in place to actually control noise from loudspeakers and fireworks at the local level?

ANALYSIS
  • The court examined the medical and environmental understanding of noise, concluding that noise is a wrongful contamination of the environment causing material injury — it contaminates the surroundings, causes nuisance, and damages both physical and mental health, and should therefore be treated as a pollutant in exactly the same way as air or water pollution.
  • Having classified noise as a pollutant, the court linked it directly to Article 21: the right to life is not mere survival but the right to live with dignity in a wholesome environment, and once noise exceeds a reasonable limit, it offends this right. This meant citizens could invoke a fundamental-rights remedy against excessive noise, not merely a nuisance claim under ordinary law.
  • To make this right enforceable in practice rather than only in principle, the court issued systemic directions: District Magistrates and Sub-Divisional Magistrates were empowered to issue prohibitory orders under Section 144 of the Code of Criminal Procedure, 1973, fixing the permissible hours for loudspeaker use at religious places and other social gatherings and functions.
JUDGEMENT

The Delhi High Court held that noise beyond a reasonable limit is a pollutant that violates the right to life under Article 21, and directed that District Magistrates and Sub-Divisional Magistrates be empowered to issue prohibitory orders under Section 144 CrPC to limit loudspeaker hours at religious places and social functions.

CONCLUSION

This case is a foundational authority for treating noise pollution as a violation of Article 21, not just an ordinary nuisance, and for turning that right into an enforceable local mechanism through Section 144 CrPC. It laid the groundwork that later Supreme Court decisions on noise pollution — including the nationwide "In Re: Noise Pollution" directions — built upon.
