FACTS

The Earl of Halifax, one of the King's principal Secretaries of State, issued a general warrant directing Nathan Carrington and three other King's messengers to make strict and diligent search for the plaintiff, John Entick, who was suspected of writing seditious and libellous articles in a periodical called "The Monitor, or British Freeholder", and to seize him together with his books and papers. Acting under this warrant, Carrington and the other defendants broke open the outer door of Entick's dwelling house, and thereafter broke open the locks of his desks, boxes, and drawers, searched through his private papers for about four hours, and carried away a large quantity of his books and manuscripts. Entick was neither arrested nor charged with any offence arising out of the search. He brought an action of trespass against Carrington and the other messengers for breaking into his house and taking his papers. The defendants pleaded the Secretary of State's warrant as their justification, asserting that such general warrants had long been issued and executed by settled practice, and that the exigencies of state in suppressing seditious publications required this power.

JUDGEMENT

Lord Camden C.J. gave judgment for the plaintiff, holding Carrington and the other defendants liable in trespass for breaking into Entick's house and seizing his papers, and awarding him damages. The Secretary of State's general warrant was declared to be without any foundation in law and therefore void; it afforded the defendants no justification whatsoever, since no statute, judicial precedent, or principle of the common law could be found authorising a Secretary of State to issue such a warrant. The court held that an act which would otherwise be an actionable trespass does not cease to be one merely because it was done under the colour of state authority, and that officers of the Crown who act without lawful warrant are personally answerable in trespass exactly as any private individual would be.

Entick v. Carrington is one of the most celebrated cases in English constitutional and tort law.
